DIVORCE REQUIREMENTS

We are sad about the fact that you want to get divorce from your spouse. Our Masjid’s aims and goals are to increase the number of chances that we can keep a family together. In Islamic law, a plan for a divorce is not encouraged, as it is the most disliked Halal thing that a Muslim could indulge! Our Masjid encourages disputing spouses to go to counseling therapy before they reach the last and final decision for a divorce! We are going to welcome you, on every possibility and chance, that you are open to being mediated with your spouse and it is something that we have higher aspirations for!

In case that is not possible for whatever reason might be, the following requirements are prerequisites for an Islamic Divorce here at the ISBCC.

  • Civil Divorce Documents from a Court to be presented before the Imam.

    NO EXCEPTIONS !

  • The husband shall bring two Muslim male witnesses not related to either spouse!
  • All parties need to show ID and are ready to sign an agreement on child support, if necessary!
  • If the dispute involves material wealth, both husband and wife will be ready to accept the final decision of Imam
  • The possibility of children existing in this marriage means that both parties have to agree to equal custody under the Islamic Law!
  • One party refusing means that we regret making a Divorce happen!
  • The Wealth agreement should be signed prior for an Islamic divorce to take place!
  • The husband must pay $500 for divorce, and another $500 for wealth agreement paperwork if needed. Payment is made by a wife in a Khulu’ case!
  • Divorce submission must be initiated by the husband.
  • Khulu’ Divorces need an extra step of investigation by the Imam with both parties
  • There has to be reasonable cause and tangible evidence that supports your case of Khulu’ Divorce!
  • “ He says she says ” will not be allowed as factual evidence and or supporting material to enter in a divorce judgment! You can expect a response generally within 48 hours.
